Angie Stone’s Family Makes Devastating Claims About Her Death in New Lawsuit

Angie Stone‘s family have made new claims about the singer’s death in a lawsuit.

According to court documents filed in Atlanta’s Gwinnett County on Tuesday, Sept. 2 and obtained by WSB-TV, the late singer’s family filed a lawsuit against Daimler Truck North America, the tractor-trailer company that owned the vehicle, and the driver, Jared Wilkinson, that was involved in the car crash on Interstate 65 that killed Stone in March.

Following a performance in Mobile, Ala., Stone and several others were traveling through Atlanta when the Mercedes-Benz Sprinter van’s driver, Wilkinson, allegedly lost control of the vehicle and it flipped over.

However, the suit alleges that Stone was alive after the van overturned, and the tractor-trailer that crashed into the van caused her death.

The lawsuit claimed that the singer had survived the initial car crash and had “consciously suffered” while underneath the Sprinter van.

When trying to exit the vehicle with the help of “Good Samaritans,” five of the nine occupants were brought to safety before the tractor-trailer — carrying a load of sugar — then crashed into the overturned van.

The driver of the van allegedly “was not paying proper attention to the roadway ahead of him,” per the lawsuit. The tractor-trailer’s collision mitigation system, Detroit Assurance 5.0, which is designed and sold by Daimler Truck North America LLC 3, was allegedly not working properly and didn’t warn the driver about the crash ahead.

As a result, Wilkinson never applied the brakes, the court documents alleged.

The lawsuit alleges that “at the time the CRST tractor-trailer slammed into the overturned Sprinter van,” Stone was still inside and attempting to escape from the van. “The force of the impact was extremely severe. As a result of the collision, Angie Stone was ejected from and pinned underneath the Sprinter van.”

Per the complaint, Stone “remained trapped underneath the van, where she consciously suffered until she ultimately succumbed to the fatal injuries she sustained in the collision and died.”

Stone’s family is seeking a trial by jury and for the trucking company to pay for hospital bills, funeral expenses, attorney fees, and other damages “recoverable by law.”

“We extend our sincere condolences to the victims of this incident and their families during this difficult time,” Daimler Truck North America tells PEOPLE in a statement. “We cannot comment on pending litigation at this time.”

Stone died on March 1, a representative for the musician confirmed to PEOPLE. Stone’s daughter, Ladi Diamond, also confirmed her death in a Facebook post. “My mommy is gone,” she wrote at the time.

Days after her death, Stone’s family released a statement thanking fans for their support during the difficult time.

“Her daughter Diamond, and son Michael want to thank you all for reaching out to the family,” they wrote via Instagram. “They ask that you respect their privacy as they grieve the loss of their mother.”
