Denise Richards Requests Spousal Support from Ex Aaron Phypers

Denise Richards is making new requests amid her ongoing divorce from ex Aaron Phypers.

The 54-year-old actress submitted a response to Phypers’ July petition for divorce on Wednesday, Sept. 3, according to documents obtained by PEOPLE. In her filing, Richards asked that Phypers, 52, pay her spousal support and that the court terminate its ability to award him support.

She also requested that Phypers be responsible for her attorney’s fees, and stated that “the full nature and extent” of her “separate property assets and debts are unknown at this time,” as is that of their community assets. 

Richards listed their date of separation as “TBD,” although Phypers previously said it was July 4.

In his petition for divorce, Phypers stated that he had “not made income” since 2024, when he “had to close down” his wellness company, Quantum 360 Club.

He further claimed that Richards earns more than $250,000 a month from her OnlyFans account, TV work, brand deal and appearances. He requested spousal support payable by Richards, alleging that their typical expenses totaled an estimated $105,000 per month.

Phypers claimed that about $15,000 of that amount was spent on eating out, while $10,000 went toward groceries and household supplies. He also alleged that, in addition to their $18,000 monthly rent, The Real Housewives of Beverly Hills alum spends $20,000 a month on clothes.

Miscellaneous expenses allegedly included $15,000 for entertainment, gifts and vacations, $8,000 for utilities, $7,000 for child care for Richards’ adopted daughter, Eloise, $5,000 on maintenance and repairs, $5,000 on laundry and cleaning, $1,500 for cars and transportation and $500 for their phone bill.

Phypers reported that they spent $0 per month on life and accident insurance, savings and investments and charitable contributions. Asking to keep certain assets and debts separate, Phypers specifically requested his power tools, motorcycle and sports car.

In August, Richards claimed that Phypers was getting evicted from their Calabasas home after failing to pay rent.

The Wild Things star filed a request for her ex to vacate the property, where he resided with his parents and brother, so she could retrieve her dogs and belongings without violating the temporary restraining order they have in place.

While she stated that both she and Phypers were named on the lease, Richards claimed that she hadn’t lived there for two years and told Phypers in January that he would be solely responsible for rent while occupying the house.

Per the filing, the landlord informed Richards that despite several attempts to contact Phypers about unpaid rent, he has been unable to reach him, resulting in an eviction.

Days after Phypers filed for divorce, Richards accused him of physical abuse throughout their six years together.

“Aaron would frequently violently choke me, violently squeeze my head with both hands, tightly squeeze my arms, violently slap me in my face and head, aggressively slam my head into the bathroom towel rack, threaten to kill me, hold me down with his knee on my back to the point where I would have to plead with him to get off me so that he would not kill me and hack into my laptop and phone and download all of my text messages,” Richards alleged in court documents obtained by PEOPLE. 

“Aaron regularly threatened to ‘break my jaw’ and would cry, beg me to stay, and promise to get help — none of which ever happened,” she continued, adding that Phypers allegedly “has caused me at least three concussions.”

Phypers has denied the reality star’s claims.

“Let me be unequivocally clear: I have never physically or emotionally abused Denise — or anyone,” he told PEOPLE in a statement at the time. “These accusations are completely false and deeply hurtful. Denise and I, like many couples, have faced our share of challenges, but any suggestion of abuse is categorically untrue.”
