Jay Cutler Sued by Man He Hit in During DUI Accident in Tennessee

Jay Cutler has been sued by the man he hit when he was driving under the influence on Oct. 17, 2024, in downtown Franklin, Tenn., according to the filing obtained by PEOPLE.
Perry Lee, who claims the former NFL quarterback was at “fault for the collision,” sued Cutler on Tuesday, Sept. 2.
“Cutler failed to use reasonable and due care in the operation of the vehicle he was driving so as to avoid injury to other persons using the roadway, including [Lee].” Lee’s attorney, Sydney Pierce, wrote in the suit, noting that Cutler was intoxicated at the time of the crash.
Lee received unexpected medical bills and other expenses due to the crash, per the lawsuit. Lee “endured physical pain and mental suffering,” as well as a “loss of enjoyment of life as a direct and proximate result of the collision,” the document reads.
Lee is also seeking unspecified compensatory damages, noting that he “suffered lost wages, loss of earning capacity, or other out-of-pocket expenses, or some combination thereof, as a direct and proximate result of the collision.”
“Our client is a veteran who was injured in a car crash due to the alleged negligence of another driver,” Pierce and Morgan & Morgan founder John Morgan said in a statement to PEOPLE on behalf of Lee. “His injuries from the crash cause him daily pain and have eroded his quality of life. We are seeking justice for him so he can get the care he needs and try to move forward with his life.”

Cutler pleaded guilty before a Williamson County, Tenn., judge on Tuesday, Aug. 26. He will serve four days at the Williamson County Jail beginning on Monday, Sept. 29, and will pay a $350 fine.
He will also be on unsupervised probation for one year and must attend a DUI safety class. His Tennessee license has also been revoked.
Cutler was arrested on Oct. 17, 2024, after he rear-ended a blue GMC with his Dodge Ram truck, WSMV reports.
Cutler also allegedly attempted to flee the scene before offering to pay the driver of the vehicle $2,000 if he didn’t call the police, according to documents previously obtained by PEOPLE.
Upon the Franklin Police Department’s arrival, the officers on site alleged that they “noticed a strong odor of alcohol” on the former NFL star at the scene of the collision.
“Cutler was also slurring his words and had blood shot eyes,” the Franklin Police news release said. “Cutler refused field sobriety tests and was taken to a local hospital where a blood sample was obtained through a blood search warrant.”
Cutler allegedly had two firearms in his vehicle, including a loaded pistol.

On the day of his arrest, Cutler was charged with DUI, possession of a handgun while under the influence, and implied consent and failure to exercise due care to avoid a collision. He was released on $5,000 bond. The gun charge was dropped as part of the guilty plea, WGN reported.
